We’re in the throes of baseball season and fans everywhere will be attentively watching their teams duke it out over a lengthy 162 game season. Usually, we expect athletes to be injured in an accident on the field. After all, they’re doing the dangerous part and spectators are spectating. That is until spectators are inattentive to errant…hot dogs? At the end of June, Kathy McVay was sitting in the stands at Citizens Bank Park cheering on the Philadelphia Phillies. During an inning switch the Phillie Phanatic, the baseball team’s absurd mascot, drove around the field doing its customary hot dog launch. Yes, from a cannon, it blasts duct tape wrapped hot dogs into the stands and it’s been doing so for years without issue. Until Kathy McVey. The rogue hotdog flew into the stands and hit McVay directly in the face hard enough that she had to have a CT scan that, fortunately, showed she didn’t have a concussion.”It just came out of nowhere. And hard. I have a small hematoma on my eye. And mostly, it’s going to get worse before it gets better. It’s going to go down the side of my face,” McVay reported, with a substantial black eye to show. Some 52% of personal injury claim cases are from car accidents, but this one carries far fewer data. McVay is an avid Phillies fan and has no plans to press charges or hire a personal injury lawyer. She’s been a good sport about the whole thing and even laughed about the ordeal noting she understood the dangers of a baseball but never thought of a hot dog. The Phillies felt bad about the incident and offered her free tickets to another game during the season, which she plans to attend a bit more warily when the cannon wielding Phanatic takes the field. For some, that would’ve incited an immediate personal injury claim. Luckily for the Phillies, McVay isn’t too bothered by the hot dog happenstance. She thinks it’s all in good fun. “It gives people a good laugh and if that makes somebody chuckle, that’s fine,” she said with a smirk. Good game, Kathy, good game indeed.
